Competition Terms and Conditions

 

The following terms and conditions were created for the Nurch Perks game to win 10,000 Nurch points drawn on the 2nd of December 2020.

The entrant must:

  1. Be 18 years of age or over, an Australian resident.
  2. Be a member of Nurch Childcare Loyalty Rewards.
  3. Be an individual and not a company or organisation.
  4. Accept the Terms and Conditions of this competition.
  5. Treat any request for fee as fraudulent activity and report to authorities. The entry to this competition is free.
  6. Not be employees or agents of Nurch.

 

The post or posts required are: 

The following outlines the post requirements.

  1. It must be made after 1st October 2020 and no later than 1st December 2020.
  2. The post must be made via Facebook and/or Instagram.
  3. It must include a video/picture of the reward purchased using Nurch points.
  4. It must name the retailer you shopped with.
  5. It must be a post, stories do not apply.
  6. It must be a public post, private posts cannot be seen or judged.
  7. It must include the hashtags #NurchPerks #NurchChildcareLoyaltyRewards #NurchMember.

 

Nurch will;

  1. Not award the prize if the entrant fails to comply with the terms and conditions.
  2. Not take any responsibility for late, lost, misdirected or delayed entries.
  3. Not take any responsibility for any emails which are entered incorrectly, misdirected or end up in the spam folder.
  4. Not accept any responsibility for any tax implications that arise, and the entrant must accept their own financial advice in relation to the prize or acceptance of the prize.
  5. Check the validity of the entrant’s details to ensure the entrant has complied with the terms and conditions of this competition.
  6. Reserves their right to cancel, exclude, forfeit any entrant partaking in this competition at any time.

 

The competition:

  1. Opens on 1st October 2020 at 7am and close on 1st of December 2020 at 11:59pm AEDT.
  2. The winner will be chosen no later than the 2nd of December 2020 at 9:00pm AEDT.
  3. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of computer virus, communication network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of Nurch, they may in its sole discretion cancel, terminate, modify or suspend the promotion and invalidate any affected entries, or suspend or modify a prize.

 

 

The prize is:

  1. 10,000 points supplied by Nurch to a Nurch active member account only.
  2. The terms and conditions relating Nurch will apply.
  3. This prize is not redeemable for cash or transferable and Nurch accepts no responsibility for any variation of these prizes. 

The winner is:

  1. Judged on the quality and effort of the post.
  2. Notified via Facebook and/or Instagram via direct message.
  3. Required to respond. If the message sent bounces or no response is received within 48 hours, the competition will be rejudged, and another winner will be chosen.
  4. Will have their full name published on the Nurch Facebook and Instagram page.

 

Nurch reserves the right to use:

  1. The winners name, image, text or voice for unlimited promotional purposes for an unlimited time period without any remuneration owed to any entrant.

 

Disputes:

  1. Nurch Childcare Loyalty Rewards’ decision is final. The terms and conditions will not be waivered.
  2. No correspondence in relation to any disputes resulting from these terms and conditions will be entered into.

 

Jurisdiction and applicable Law:

  1. Nurch is based in Brisbane, Australia and this agreement is subject to Australian legislation. Any legal action arising out of relating to the terms and conditions of this competition will be filed in the State and Federal Courts located in Brisbane, Queensland.

 

 

Liability and warranty:

  1. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  2. Nurch accepts no responsibility for any loss or damages if there are any changes in Competition dates, times or values of prize components, for any incomplete, late, lost or misdirected entries or for any inability for any entrant to access, view or load the Website.
  3. In the event Nurch postpones or varies the Competition or any elements of a prize, it (and any party associated with the Competition) will not be liable to any person for any loss or damage of any kind (including but not limited to indirect or consequential loss or loss or damage caused by Nurch or any other party’s negligence) arising out of, or in connection with, the postponement or variation of the Competition or a prize, nor will the Promoter or other party be liable for any loss, damage, payment or expense of any kind (including but not limited to indirect or consequential loss or damage caused by the Promoter’s or other party’s negligence) or personal injury or other damage suffered or sustained as a result of entering, judging, running, cancellation or acceptance, enjoyment or use of the Competition or a prize or any aspect of or access to the Website.
  4. While the Promoter takes care to ensure all information relating to the Competition is correct, it does not warrant the accuracy or completeness of all information provided and will not be liable for any inaccuracy, omission or error. Entrants should make their own enquiries to verify all information provided.
  5. The Promoter reserves the right in its discretion, subject to any approval or directions from regulatory bodies, at any time during the Competition Period to vary, withdraw, postpone or cancel the Competition or any prize including where in the Promoter’s opinion no entry satisfies the entry requirements or it cannot conduct the Competition or grant a prize for any other reason beyond its control.
